Reps. Sykes, Malliotakis, Horsford, LaLota, Suozzi, Fitzpatrick Introduce Bipartisan No Tax on Overtime for All Workers Act
WASHINGTON, D.C. — Today, U.S. Representatives Emilia Sykes (D-OH), Nicole Malliotakis (R-NY), Steven Horsford (D-NV), Nick LaLota (R-NY), Tom Suozzi (D-NY), Brian Fitzpatrick (R-PA) introduced the bipartisan No Tax on Overtime for All Workers Act to expand the no tax on overtime provision for workers whose eligibility was excluded from the provisions included in H.R. 1, the “Big Beautiful Bill”. The No Tax on Overtime for All Workers Act broadens the definition of qualified overtime compensation to include overtime work done by workers who are covered under the Railroad Labor Act and includes overtime as it is defined by collective bargaining agreements.
H.R.1 defined “overtime” using the Fair Labor Standards Act (FLSA), which poses several issues, first: not all workers are covered under FLSA. Many transportation workers, including in the airline and railroad sectors, are subject to the Railroad Labor Act and under current law, their overtime pay is still subject to federal income tax. FLSA also does not take into account how collective bargaining agreements define full-time and overtime work and uses unrealistic formulas for computing overtime hours for some workers, including emergency responders.
“American workers deserve a break. This bill will eliminate tax on overtime, giving people more breathing room and more money in their pockets. As a champion of working people, I’m proud to lead this bipartisan bill to ensure all workers get the benefit of no tax on overtime,” said Rep. Sykes.

The No Tax on Overtime for All Workers Act is endorsed by the Teamsters, International Association of Firefighters, Transportation Trades Department of the AFL-CIO, Airline Pilots Association, and Transportation Workers Union.
"No taxes on overtime pay simply means that American workers can keep more of their hard-earned wages and better support their families," said Teamsters General President Sean M. O’Brien.
